Fureelz Terms of Use
Welcome to Fureelz™! These Terms of Use (“Terms”) govern your access to and use of the Fureelz™ mobile app, website, marketplace, and all related services we provide (collectively, the “Services”). By using the Services, you agree to these Terms, our Privacy Notice, Community Guidelines, and Standards Against Child Sexual Abuse and Exploitation (together, the “Policies”). If you do not agree, DO NOT use the Services.

1.1 Agreement. By accessing or using the Services, you agree to these Terms and the Policies.
1.2 Eligibility & Age. You must provide accurate age information during registration. We may use age verification technologies and require additional verification if we suspect you are under 13. If you are under the age of majority where you live, your parent or legal guardian must review and consent to your use through our parental consent process. Where local law requires a higher age or parental authorization (including but not limited to users under 16 in the EEA or under the applicable age in your jurisdiction), you may use the Services only if those requirements are met and verified through our consent mechanisms. We may restrict access where we cannot meet local youth safety rules. We reserve the right to request additional age verification documentation at any time.
1.3 Accounts & Security. Keep your information accurate and your credentials secure. Do not share your account. Use only devices you own or control. We may request verification (e.g., email/phone) and may disable accounts that appear compromised or underage.
1.4 Community & Safety. Follow our Community Guidelines: [insert]. Do not engage in harassment, hate, illegal activity, scams, grooming, doxxing, or animal harm. We use automated tools and human review to enforce these Terms, limit visibility, restrict features, or suspend/ban accounts. You can appeal decisions via in‑app tools.
1.5 Child & Teen Protections. We apply teen‑safe defaults (such as, private accounts for 13–15, limited DMs/comments, stronger filters, and no precise location sharing). We may use reasonable age‑assurance measures and will remove under‑13 accounts when discovered. See our CSAE Standards.

2.1 Your Content & License. You own the content you create (User Content). You grant Fureelz a nonexclusive, worldwide, royalty‑free, transferable, sub-licensable license to host, store, cache, reproduce, adapt, publish, translate, distribute, publicly perform and display, and create derivative works from your User Content to operate, provide, improve, and promote the Services (including moderation, search, recommendations, and format conversions). This license ends when you delete User Content, except that: (a) content shared with others may persist until they delete it; (b) we may keep backup, audit, safety, or legal copies for a limited time; and (c) derivative works that do not identify you personally may be retained.
2.2 Your Promises. You have the rights needed for your User Content (including music and third‑party media), and your User Content does not infringe intellectual property, privacy, or publicity rights or violate law. You will follow our Community Guidelines.
2.3 Our IP. Fureelz and its licensors own the Services, software, and brand assets. Do not copy, reverse engineer, or misuse them. Do not use our names, logos, or trademarks without permission except for truthful, nominative fair use.
2.4 Feedback. If you send ideas or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty‑free license to use them without restriction or compensation.
2.5 DMCA & Repeat Infringers. To report copyright infringement, send a notice per 17 U.S.C. § 512(c)(3) to our DMCA Agent: DMCA@fureelz.com, or via the Contact page. Counter‑notices may be submitted under § 512(g)(3). We may terminate repeat infringers and may share notice/counter‑notice information with the other party as required by law.2.6 Third‑Party Services. The Services may interoperate with third‑party services (for example, payment processors, embedded media, logins). Those services are governed by their own terms and privacy policies. We are not responsible for third‑party services.

3.1 DMs & Groups. Use DMs and groups [groups are coming soon] respectfully. No harassment, grooming, sexual content, spam, malware, or scams. We may limit or block DMs/comments to protect users—especially minors—and may scan messages for safety signals as described in our Privacy Notice.
3.2 Creator Monetization. [Coming soon!] Any creator monetization programs (for example, revenue shares, bonuses, gifts) are governed by separate terms that we will provide. Eligibility, metrics, and payouts may change. KYC/tax information may be required. Monetization programs may be limited to users 18+.3.3 Fureelz Marketplace. [Coming soon!] We plan to provide a marketplace that allows buying and selling of pet-related products. As a marketplace operator, we are not the seller of third-party products and do not take title to any products. Sellers are responsible for listings, product compliance, fulfillment, shipping, taxes, customer service, returns, refunds, and all legal obligations related to their products. We may charge a platform fee for each transaction, which will be deducted from seller payouts. All fees are disclosed at the time of listing. Prohibited products include illegal, unsafe, counterfeit, or infringing items, and any products that violate our Community Guidelines. Users under 18 cannot receive payouts or operate seller accounts. Sellers must provide accurate tax information and comply with all applicable tax obligations. Payment processing is handled by PCI DSS-compliant providers including Stripe, Inc., whose terms apply to all transactions; see our Privacy Policy for data processing. Buyers may dispute transactions through our dispute resolution process or directly with the payment processor. We may suspend or terminate seller accounts for violations of these terms or applicable law. Final Fureelz Marketplace terms will be posted and incorporated when available.
3.4 Fureelz Giving. [Coming soon!] We plan to offer features that connect users to vetted animal charities via third‑party processors. We do not solicit, receive, control, or process donations. Final Fureelz Giving terms will be posted and incorporated when available. IMPORTANT: Fureelz acts solely as a technology platform facilitating connections between users and charities. We do not solicit, receive, control, or process donations directly. We are not a charity, fundraising organization, or payment processor.
3.5 Charity Relationship: All donations are made directly to the selected charity through third-party processors. The charity, not Fureelz, is responsible for: (a) providing tax receipts; (b) compliance with charitable solicitation laws; (c) proper use of donated funds; (d) IRS reporting obligations; and (e) all other legal obligations related to charitable activities.3.6 No Guarantees: We do not guarantee that donations will be used for any particular purpose, that charities will remain operational, or that tax receipts will be provided. Users should independently verify charity status and activities.
3.7 Disputes & Risk. For Fureelz Giving any disputes regarding donations must be resolved directly with the charity or payment processor. We may assist at our discretion but have no obligation to resolve donation-related disputes. For the Fureelz Marketplace, buyers and sellers should try to resolve issues directly. We may assist at our discretion but do not guarantee resolutions.
3.8 Changes & Availability. We may change, test, remove, or suspend features or the Services at any time. We are not liable for resulting loss or inconvenience.

4.1 Privacy Policy. Your use of the Services is governed by our Privacy Notice. It explains what we collect, how we use and share information, legal bases, your rights, and our safeguards. By using the Services, you agree that we may handle your information as described there, and the Privacy Notice is incorporated into these Terms.
4.2 Moderation & Safety. You must follow our Community Guidelines and our Standards Against Child Sexual Abuse and Exploitation (CSAE), both of which are incorporated into these Terms. We maintain a zero‑tolerance policy toward child sexual abuse and exploitation and may report detected CSAM to NCMEC (U.S.) and other authorities where required by law. We use automated tools and trained reviewers to detect and address policy violations (for example, spam, grooming, animal harm, CSAM). We may scan messages for safety signals as permitted by law.4.4 Children’s Privacy. We do not knowingly allow under‑13 users. For teens under the age of majority, we apply teen‑safe defaults and, where required by law, may seek parent/guardian authorization.
4.4 International Transfers. We primarily store data in the United States. For transfers from other regions, we use approved safeguards (for example, SCCs/UK Addendum) and supplementary measures where needed.

5.1 Enforcement & Appeals. We may remove content; limit visibility; restrict features; suspend or terminate accounts; and notify authorities as required by law. You may appeal moderation actions via in‑app tools.
5.2 App Stores. Your download and use may be subject to Apple App Store and Google Play terms. Apple and Google may be third‑party beneficiaries and may enforce applicable terms.
5.3 Export/Sanctions. You represent and warrant that you are not a sanctioned or restricted party and will not use the Services in embargoed countries/regions or in violation of export or sanctions laws. You will not export or re‑export the app except as permitted by law.5.4 Dispute Resolution (U.S. Users). If you are a U.S. resident, or if you bring a claim in the United States, you and Fureelz agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services by binding arbitration on an individual basis. Either party may bring an individual claim in small claims court. Either party may seek injunctive relief in court to protect intellectual property or address child‑safety matters. You and Fureelz waive any right to participate in a class, collective, consolidated, or representative proceeding. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (www.adr.org). A single neutral arbitrator will decide the dispute. The arbitration will take place in New York, New York, USA, or in the county where you live, or by video/teleconference if the arbitrator permits. New York law governs this arbitration agreement and any arbitration, without regard to conflict‑of‑laws rules. The AAA rules govern fees; if the arbitrator finds your claim is not frivolous, Fureelz will pay fees the rules do not require you to pay.
5.5 Dispute Resolution (Non-U.S. Users). If you reside outside the United States and bring your claim outside the United States, disputes will be resolved in the courts of your usual place of residence under the laws of your country, to the extent required by mandatory local law. Nothing in these Terms limits your consumer protection rights under mandatory local law.5.6 General. Regardless of the above, either party may seek injunctive or other equitable relief in any court with jurisdiction to prevent misuse or infringement of intellectual property or protect child safety. Either party may bring qualifying claims in small claims court. If any part of this section is found unenforceable, that part will be severed and the remainder enforced. Where a class‑action waiver is unenforceable, the arbitration agreement will not apply and disputes will proceed in court.

6.1 Changes. We may update these Terms by in‑app notice or email. Continued use means you accept the updates.
6.2 Termination. We may suspend or terminate your access for any reason, including violations of the Policies. You may delete your account via the app or by contacting privacy@fureelz.com. Some obligations survive termination (for example, IP, privacy, disclaimers, liability, dispute resolution).
6.3 Disclaimers & Liability. The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties (including merchantability, fitness, title, non‑infringement) and any warranties arising from course of dealing or usage of trade. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenues, goodwill, or data. Our total liability for all claims will not exceed the greater of US$100 or amounts you paid us (if any) in the 12 months before the event. Nothing limits liability where prohibited by law.
6.4 Indemnification. You will defend, indemnify, and hold harmless Fureelz Inc. and our affiliates, and our directors, officers, employees, and agents, from and against any third‑party claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content (including alleged IP, privacy, or publicity violations); (b) your violation of law or these Policies; or (c) your willful misconduct, fraud, gross negligence. We will notify you of any claim and reasonably cooperate at your expense. You will not settle any claim that imposes obligations on us or admits liability without our prior written consent. To the extent required by law, this indemnity does not apply to the extent a claim is caused by the Services (excluding User Content and third‑party services).
